These terms and conditions of use for our website at eyeology.com, including any related media, channels, or applications connected to it (collectively, the “Website”), constitute a legal agreement between you and Eyeology Management Inc., operating as Eyeology (“Eyeology,” “Company,” “we,” or “us”). Together with any documents they expressly incorporate by reference (these “Terms”), they govern your access to and use of the Website, including its content, functionality, and services.
By using the Website, you accept and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not access or use the Website. You may browse the Website for general information (such as services, hours, and locations) without being of the age of majority; however, by submitting any form you represent that you have the legal capacity to do so.
2. Nature of the Website and our business
Eyeology-branded clinics are operated independently, and clinical optometric care is provided by licensed optometrists at the applicable clinic. The Website provides information about our services, clinic locations, eyewear, and franchise opportunities, and directs you to each clinic’s own booking page or contact details.
- Appointment booking. You cannot book an appointment directly through the Website. When you select a clinic and choose “Book appointment,” you are directed to that clinic’s online booking page (a Google Calendar appointment-scheduling page) or to contact the clinic directly. Availability and scheduling are managed by the clinic and its systems.
- Payments. The Website does not collect or process payments. Fees for services or eyewear are handled directly with the clinic.
- Forms. Forms are for general, eyewear/retail, franchise, partnership, media, or website-support questions only — not for appointment booking, medical information, symptoms, health-card details, or urgent eye concerns.
3. No medical advice; urgent eye concerns
Information on the Website is provided for general informational purposes only and is not medical advice, diagnosis, or treatment, and does not create an optometrist–patient or provider–patient relationship. Always seek the advice of a qualified eye-care or health professional regarding any medical condition or symptoms.
Please do not use this Website for urgent or medical concerns. For an urgent eye problem, contact an eye doctor or go to your nearest emergency department right away.
4. Changes to the Terms and the Website
We may revise and update these Terms from time to time in our sole discretion; changes are effective when posted. Your continued use of the Website means you accept the changes. We may also change, withdraw, or terminate the Website or any part of it at any time without notice, and are not liable if all or part of the Website is unavailable.
5. Intellectual property
The Website and all of its content, features, and functionality — including the Eyeology brand, logos, names, designs, images, text, and slogans — are owned by Eyeology or its licensors and are protected by copyright, trademark, and other laws. You may use the Website for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content except as expressly permitted by these Terms or with our prior written consent.
6. Your submissions
If you submit information through a form or otherwise provide content to us (“Submissions”), you represent that it is accurate and that you have the right to provide it. You grant us a non-exclusive, royalty-free, worldwide licence to use Submissions for the purpose of responding to and coordinating your request and operating our business. Do not include medical or personal health information in any Submission.
7. Prohibited uses
You agree not to use the Website: in any way that violates applicable law; to transmit any unlawful, harassing, defamatory, or harmful content; to impersonate any person or entity; to introduce malware or attempt to gain unauthorized access to the Website or its systems; to interfere with the proper working of the Website; or to violate the terms of any third-party platform linked to the Website.
8. Third-party platforms and websites
The Website directs you to, and may link to, third-party platforms and websites — including clinic booking pages hosted by Google, Google Maps, and our website host and analytics providers. We do not control these third parties and are not responsible for their content, availability, terms, or privacy practices. Your use of them is governed by their own terms and policies.
9. Disclaimer of warranties
YOUR USE OF THE WEBSITE AND ITS CONTENT IS AT YOUR OWN RISK. THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 11. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Eyeology, its affiliates, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses arising out of your violation of these Terms or your use of the Website.
12. Governing law and jurisdiction
The Website and these Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario.
13. Waiver and severability
No failure or delay by us in exercising any right under these Terms operates as a waiver of that right. If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
